Policy: Public Funded Event Expenditures

Background: Section 59-101-187 (Act 70 of the 1999 South Carolina General Assembly as approved by the Governor on June 11,1999) authorizes public institutions of higher learning to expend specific funds for events which recognize academic and research excellence and noteworthy accomplishments of members of the faculty, staff, students, and distinguished guests of the institution in accordance with a written policy of the governing board of the public institution of higher learning and requires that the written board policy be forwarded to the Commission on Higher Education.

Recommendation: Pursuant to the statutory authority referenced above, it is recommended that the Clemson University Board of Trustees implement the provisions of Section 59-101-187 of the South Carolina Code of Laws by adopting the following policy:

A reasonable expenditure of public funds is authorized for events that recognize academic and research excellence and noteworthy accomplishments of the faculty, staff, students, and distinguished guests of Clemson University. The only authorized sources of public funds for this type of expenditure will be the following:

  1. Revenues derived from athletic or other student contests;
  2. Revenues from the activities of student organizations;
  3. Revenues from vending operations and bookstores;
  4. Revenues from approved private practice plans; and
  5. All other nonappropriated state funds.

The expenditure of funds from the approved sources above and for the purpose stated in this policy shall be deemed to be a reasonable expense which is related to the mission of Clemson University and meets the public purpose test for the expenditure of public funds. In addition, the Clemson University Board of Trustees is cognizant of the fact that the funds derived from athletics, vending operations, bookstores, tuition and other student fees are pledged to the retirement of various Clemson University bonds, and therefore are required to be expended in accordance with their respective bond resolutions.

The Clemson University Administration is directed to forward a copy of this policy to the South Carolina Commission on Higher Education upon its adoption by the Clemson University Board of Trustees.

Rationale: The Board of Trustees is asked to adopt the above policy to implement Section 59-101-187 of the South Carolina Code of Laws which authorizes the use of public funds for certain events that heretofore would have required the use of private funds to comply with state law.
