An H-1B visa is a nonimmigrant worker's visa. The H-1B classification applies to persons in a specialty occupation which requires the theoretical and practical application of a body of highly specialized knowledge requiring completion of a specific course of higher education. This classification requires a labor attestation issued by the Secretary of Labor. International Services (IS) is responsible for all Clemson University H-1B petitions because a foreign individual can neither apply for nor obtain the H-1B status on his or her own.
To initiate an H-1B petition, the hiring department must complete Form IS-400, Request for H-1B Petition, and submit the completed form along with the supporting documents listed on the form to International Services. We suggest that hiring units contact us as soon as the hiring decision is made. The processing time required for approval of an H-1B visa can vary considerably from one petition to another but is normally a minimum of 4 months.
