WHAT IS PRE-TRIAL INTERVENTION?
Pre-Trial Intervention (PTI) is just as the name implies. It is an intervening into a case before it comes to court. This system allows a participant to be diverted from conviction, enter a program of restitution, counseling and guidance, and return to society without a permanent criminal record. Only participants who do not present a threat to society and have no significant prior criminal history are allowed this "second chance."
In cases where it is appropriate to compensate victims for their losses, restitution is required from the participant before he or she can complete the program.
PTI is a self-supporting agency under the control and supervision of the Circuit Solicitor’s Office, and is supported through cooperation of judicial, law enforcement and community service agencies.
WHAT IS EXPECTED OF THE PARTICIPANT TO COMPLETE THE PROGRAM SUCCESSFULLY?
During the time a participant is in the program, he/she will be advised that any criminal arrest will terminate his/her participation. Participants are required to attend school, receive vocational training, or work at a suitable job. Restitution to the victim is mandatory. Failure to successfully complete the program results in the participant’s prosecution.
COST OF PARTICIPATION
Each participant is required to pay a $100.00 application fee before entering the program. A participation fee of $250.00 must be paid prior to the completion of the program. These fees help to defray the cost of the program.
BENEFITS OF PARTICIPATION
Opportunity to eliminate a criminal record.
Opportunity to keep driver’s license in cases where conviction would result in suspension of driver’s license (ex: Simple Possession of Marijuana, Underage Alcohol Violations)
Opportunity for South Carolina residents to retain LIFE Scholarship benefits.
