Americans with Disabilities Act
The Americans with Disabilities Act (ADA) of 1990 provides comprehensive federal civil rights protection for people with disabilities in the areas of employment, state and local government services, public accommodations, transportation, and telecommunications.
The ADA applies to qualified individuals with disabilities. To have a covered disability under the ADA, a person must have a physical or mental condition that substantially limits one or more major life activities, a history of such a condition, or be regarded as having such a condition. To be qualified under the ADA, a person with a disability must be able to perform the essential functions of a job or meet the essential eligibility requirements of the program or public accommodation, with or without an accommodation to his/her condition. The term physical or mental disability includes, but is not limited to, speech; hearing; sight and mobility; cerebral palsy; epilepsy; muscular dystrophy; multiple sclerosis; cancer; diabetes; heart disease; HIV/AIDS; emotional illness; ADHD, and specific learning disabilities such as perceptual impairments, brain injury, dyslexia, and developmental aphasia.
Postsecondary institutions that receive federal monies have been required to comply with a similar disability nondiscrimination law - Section 504 of the Rehabilitation Act of 1973. The ADA upholds, amends and clarifies the standards for compliance set forth in Section 504 and extends many of the protections of the Civil Rights Act of 1964.
